These terms and conditions govern the use of the SpainHotels website and the booking of services offered through it. By accessing the site, initiating a accommodation reservation, or purchasing products through the HotelShop service, you accept these terms and conditions. We recommend reading them carefully before proceeding.
Object and acceptance
SpainHotels is a website owned by Waak Marketing Services, SLU that offers two distinct services: a search engine for accommodations in Spain with a booking flow operated by LiteAPI (service A), and a sales channel for products and experiences published by the hotel called HotelShop (service B). These terms govern the use of the site and the contracting of both services. By accessing the site or using any of the services, you accept these terms along with the privacy policy and the cookie policy.
Service A — Accommodation Search and Booking
SpainHotels displays the availability and prices of accommodations in Spain with the aim of connecting the user with the accommodation provider. The booking flow occurs visually within the site, but the payment form, confirmation, charge, voucher issuance, and cancellation handling are performed by LiteAPI through an SDK loaded on the page. SpainHotels does not process payments, does not access card data, and is not part of the accommodation contract; the contract is established directly between the user, the hotel provider, and, where applicable, LiteAPI as the booking agent. SpainHotels is not responsible for availability, final price, specific conditions applicable to the product, accommodation quality, cancellations, or refunds: these are the responsibility of LiteAPI and the hotel provider according to their own policies. The remuneration received by SpainHotels for this service is a marketing commission paid by LiteAPI or the provider; it does not affect the price paid by the user.
Service B — HotelShop
Through the HotelShop service, hotels publish their own products and experiences on SpainHotels (e.g., dinners, massages, and complementary services). In this service, SpainHotels acts as an intermediary between the customer and the hotel: it facilitates the purchase and processes the payment through its own integration with Stripe Payments Europe Ltd., receiving a commission of ten percent (10%) on the amount of each sale. The actual provision of the product or experience is the responsibility of the hotel; SpainHotels is not liable for the quality or provision. The specific conditions (description, price, deadlines, cancellation policy) are shown to the user before confirming the purchase. In case of non-compliance by the hotel, SpainHotels acts as a facilitator to resolve with the provider.
Cancellations and refunds
The cancellation, modification, and refund conditions depend on the service and product booked. For accommodation reservations (service A), the policies of LiteAPI and the provider hotel, shown to the user before confirming the reservation, apply: SpainHotels does not establish its own deadlines or manage refunds for this service, although it can guide the user on how to contact the provider. For HotelShop service purchases (service B), the specific product cancellation policy, shown before confirming the purchase, applies; refunds, when applicable, are processed through Stripe.
Responsibility and intellectual property
SpainHotels is not responsible for services provided by third parties (hotels, booking agents such as LiteAPI or Hotelbeds, payment gateways, or other providers) nor for the availability, accuracy, or quality of information published by said third parties, without prejudice to the obligations imposed by regulations on SpainHotels as a provider of information society services. The content of the site (texts, images, trademarks, logos, design, and code) is the property of SpainHotels or its licensors and is protected by intellectual and industrial property regulations; its reproduction or commercial use is not permitted without express authorization.
Modifications, Governing Law, and Jurisdiction
SpainHotels may modify these terms to reflect legal or service changes; the version published on the site is the one that applies at any given time. These terms are governed by Spanish law. For disputes with consumers, the courts of the consumer's domicile shall have jurisdiction in accordance with the General Law for the Defense of Consumers and Users. Likewise, consumers may resort to the European online dispute resolution platform at https://ec.europa.eu/consumers/odr.
